RH Law, paggamit ng ‘police power’ ng estado – SolGen

MANILA – SA isang nakagugulat na pagbubunyag sa ikatlong sesyon ng RH Law oral kamakailan, inamin ni Solicitor General Atty. Francis H. Jardeleza, ang tumatayong depensa ng pamahalaan, na ang RH Law ay isang paggamit ng ‘police power’ ng estado upang tiyakin na hindi magkakaroon ng mga ‘di ginustong pagbubuntis sa bansa.

“[The RH law] is an exercise of the police power of the state,” pahayag ni Jardeleza, na hinirang ni Pangulong Aquino sa posisyon noong Pebrero 2012.

Ayon kay Jardeleza, may kapangyarihan ang pamahalaang itakda kung alin ang ‘unwanted pregnancy’ at alin ang hindi.
“The state has a right to determine whether a pregnancy is wanted or not because there is an effect in the economy…among others,” tugon ni Jardeleza sa sunud-sunod na tanong ni Justice Jose P. Perez.

Dahil sa pagkabahala sa ekonomiya, inamin din ni Jardeleza na nakatuon ang R.A. 10354, lalung-lalo na sa mahihirap at mga kapos sa oportunidad sa lipunan.

Nang tanungin ni Justice Perez si Jardeleza tungkol sa rason sa kabila ng kakaibang pokus ng nasabing batas sa mahihirap, binanggit ng Solicitor General na ang mahihirap ang totoong mas nangangailangan ng RH Law.

“All they are saying is they are making a finding here of social fact, that we have so many underprivileged poor, so many so much of the unwanted pregnancies,” ani Jardeleza.

Nagpahayag naman ng duda si Justice Roberto A. Abad na mayroong layuning anti-poor ang RH Law.

“The target of the RH Law is the community of poor and you want them to reduce their ranks. We want to eliminate their size,” ani Justice Abad.

Bago ang pagtatanong kay Solicitor General Jardeleza, isinalang naman sina Atty. Luis Gil Gana, counsel nina Al Tillah at Joe Kashim, na nais ipawalang-bisa ang RH Law sa kadahilanang labag ito diumano Organic Act of the Autonomous Region in Muslim Mindanao.
